West Bengal Fire Services Act

CHAPTER – III A

FIRE PREVENTION AND FIRE SAFETY
Section 11A : General public to take preventive measure for safety from fire etc.
Section 11 B : Owner or occupier of building to make or carryout arrangements necessary for fire prevention etc...
Section 11 C : Owner or occupier of High - Rise Building provide fire prevention and fire safety measures.
Section 11 J : Penalty for contravention of provision of Chapter III A.

Be punishable with imprisonment for a terms of three years which may extend to 5 years or with fine of twenty thousand rupees which may extend to five lakh rupees or with both and where the offence is and continuing one, with a further fine of one thousand rupees which may extend to ten thousand rupees for everyday during which such offence continues after the conviction for the first such offence.

Section 11 K : Penalty for furnishing false “Fire safety Certificate”.
Section 11 L : Offences cognizable and non-bail able.

CHAPTER – IV

LICENCE FOR STORING HAZARDOUS SUBSTANCE
Section 12 : Bar to use of premises for storing or processing hazardous substances without licence.

TEMPORARY STRUCTURES OR PANDALS
Section 23A : Erection of Temporary structures of pandals.

CHAPTER – V

PENALTIES
Section 23 B : Dismantling of temporary structure.
Section 26 : Penalty for not taking out a licence for a warehouse or workshop

In violation of Section 12 of this Act shall be punishable, on conviction with fine of one thousand rupees which may extend to five thousand rupees or with imprisonment for a term not exceeding two months or with both, with further fine not exceeding five hundred rupees for each day which he may continue to so use such premises.


CHAPTER – V

MISCELLANEOUS
Section 34 : Inspection of building or premises
    The Director or the nominated authority may enter and inspect any building or part thereof or any premises at any time between sunrise and sunset where such inspection appear necessary for ascertaining the contravention, if any of fire prevention of fire safety measures.
Section 35   : Issue of notice to owner or occupier to undertake fire prevention and fire safety measures.
    ………………………………………………………………………………. directing him (the owner or occupier) to undertake such measures, and within such time ………………………………….. where the owner is not available the occupier shall undertake fire safety measures in the interest of public safety.
Section 37 A : Director or superior nominated authority to seal building
Section 37 AA  : Compounding of Offences:
   
  1. The Director General or such other officer as may be ……………. For a local area, may, by general or special order either or before or after the institution of proceedings in this behalf, compound any offence punishable by or under this act or the rules made there under or withdrawn from such proceedings.
  2. When an offence has been compounded under subsection I, the offender, if in custody, shall be discharged, and no further proceedings shall be taken against him in respect offence so compounded.


NOTES : The payer for compounding of offence(s) under WBFS Act, 1950 may be filed before the Director General, West Bengal Fire & Emergency Services with the all relevant authenticated documents.

i. Every prayer / petition fact may be proved by affidavit with pleading guilty for such offences committed by the applicants.

ii. The prayer / petition may be filed in official language in conquest / demy paper.
